ACCELERATED PATENT PROCESS

Accelerated patent examination fundamentally requires applicants to do more work. In return, the applicant’s patent is prosecuted "out of sequence" by the U.S. Patent and Trademark Office (that is, it goes to the top of the pile). Additional time savings are achieved due to the applicant doing most of the examination work prior to filing, that the US Patent and Trademark Office would typically do. As a result, stringent requirements must be met and it can be a difficult process to navigate. As we work with you, if we determine that your product or product idea is a fit for the accelerated patent examination, we’ll focus on protecting your asset immediately. We will provide you with a comprehensive plan for expediting the examination of your patent application.

Here’s a breakdown of the BWS approach to the accelerated patent examination process:
  • First, we focus first on the novel aspects of your new and emerging products.
  • We’ll prepare an application on your behalf, meeting the Patent Office special requirements.
  • We’ll conduct a "pre-examination" analysis of the claims to identify and select a limited set
    of prior art references. This comprehensive "pre-exam" review is the magic elixir in getting
    through the process successfully.
  • We’ll identify commercially viable claims, write them to survive examination, then verify
    a high probability of allowance, and make claim amendments if needed.
  • We’ll file an application with claims that cover the product features you believe are winners.
  • We’ll also include an Information Disclosure Statement citing relevant prior art references.
  • You will accept claims allowed by the Patent and Trademark Office (PTO), pay the issue fee,
    file a continuation as a second related application for broader or non-allowed claims if any.
  • Additional continuations can be filed as needed to cover your technology space.
